1. Acceptance of Terms

By accessing and using 99esim.com (the "Website"), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services. You represent that you are at least 18 years old and are using the service for yourself as an individual (not on behalf of any unauthorized third party). If you are using the Website on behalf of an organization, you certify that you have the authority to bind that organization to these Terms.

2. Description of Services

99esim.com provides an eCommerce platform for the sale of digital eSIMs to facilitate global internet access. Users may browse, purchase, and manage their eSIM plans through our Website. Our service operates in partnership with third-party network providers, and thus data coverage, speeds, and availability are dependent on those providers and may vary by location or change without notice. We do not guarantee that service will be available in all areas at all times or that network coverage will be uninterrupted.

2a. Intended Use and Duration Limitations

99esim services are intended for temporary, short-term use, primarily for travelers and visitors, and are not designed to replace local mobile subscriptions or to be used as a permanent internet solution within a single country.

While customers may purchase multiple eSIM plans, continuous or repeated use in the same country beyond an extended period (typically around 90 days) may result in service limitation, suspension, or termination due to restrictions imposed by underlying network providers. Purchasing multiple plans consecutively does not guarantee uninterrupted service.

These limitations are applied by third-party carriers based on usage patterns and location and are outside of 99esim’s control. Any service interruption resulting from such restrictions does not constitute a service fault and is not eligible for refunds or compensation, except where required by applicable law.

Customers residing long-term in a country are advised to use a local mobile operator for ongoing connectivity.

3. User Registration and Eligibility

To access certain features of the Website, you may be required to register an account. You agree to provide accurate, current information during registration and to update such information as needed to keep it accurate and current. It is your responsibility to maintain the confidentiality of your account credentials and restrict access to your account. All activities undertaken through your account are your responsibility. You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to register and use our services. We reserve the right to suspend or terminate your account if information provided is inaccurate or if you are found ineligible or in violation of these Terms.

4. Acceptable Use Policy

By using our Website and services, you agree to use them only for lawful purposes and in accordance with these Terms and Conditions. Prohibited conduct includes, but is not limited to: using the eSIM service for any illegal, fraudulent, or abusive purpose; engaging in actions that could harm, disrupt, or overburden any network, system, or service infrastructure; reselling, sublicensing, or transferring eSIM services to third parties without our prior consent; or using the service on behalf of any person other than yourself.

You further agree not to violate any applicable laws or regulations (including telecommunications, data usage, and export control laws) while using the eSIM, and to comply with any acceptable use policies imposed by underlying network providers.

We may suspend or terminate your access to the Website or eSIM services, acting reasonably and in good faith, if we determine that you have engaged in prohibited conduct, violated these Terms and Conditions, or otherwise used the services in a manner that is unlawful, abusive, or harmful to our interests, other users, or third-party network providers. Such suspension or termination may occur with or without prior notice, depending on the nature and severity of the violation.

5. Product Information

We strive to provide accurate and up-to-date product descriptions, pricing, and other information on the Website. However, we do not warrant that product descriptions or other content are complete, reliable, current, or error-free. In the event of any errors (including pricing errors or inaccuracies in descriptions), we reserve the right to correct such errors and, if necessary, to cancel any orders affected by them (including after an order has been submitted). Product offerings (such as available eSIM data packages, coverage, and pricing) are subject to change at any time without notice.

6. Ordering and Payment

By placing an order on our Website, you are making an offer to purchase the selected eSIM product or plan. All orders are subject to acceptance by us, and we reserve the right to refuse or cancel any order for any reason (including but not limited to inaccuracies or errors in product or pricing information). Payment must be made at the time of order placement; all payments are processed securely through trusted third-party payment gateways, and we do not store your credit card information on our servers. You are responsible for any fees or charges applied by your chosen payment provider. Prior to completing a purchase, you will be required to confirm that your device is eSIM-compatible (for example, by checking a box during checkout). By confirming, you acknowledge that you have verified your device supports eSIM and is carrier-unlocked, and you accept responsibility for this confirmation.

6a. Pre-Purchase Acknowledgment and Customer Confirmation:
Before completing a purchase on 99esim.com, you will be required to confirm certain conditions, including that your device supports eSIM technology, is carrier-unlocked, and that you have selected the correct destination and plan for your intended use. By completing the purchase and providing this confirmation (including by selecting a checkbox or similar acknowledgment during checkout), you expressly acknowledge that you have reviewed and verified this information and accept full responsibility for your selection.

You understand and agree that failure to verify device compatibility, destination coverage, or plan suitability prior to purchase may result in the eSIM being unusable, and that such situations do not automatically entitle you to a refund or cancellation, except as expressly stated in these Terms or where required by applicable law.

7. Device Compatibility and User Responsibility

It is solely your responsibility to ensure that the device you intend to use with our eSIM is compatible with eSIM technology and network-unlocked before making a purchase. We provide information on eSIM-compatible devices, and you are encouraged to review this information or consult your device manufacturer. By purchasing an eSIM from our Website, you represent that you have a compatible device. 99esim.com will not be liable for any failure of the eSIM service due to an incompatible or locked device, and no refunds will be provided in such cases. Upon purchase, you assume full responsibility for installing and activating the eSIM on your device. We disclaim all liability for eSIM activation failures or issues arising from device-specific restrictions or unsupported device models.

7a. eSIM QR Code Validity and Device Changes
Each eSIM QR code or activation code provided by 99esim.com is valid for installation on one device only and may not be reused on multiple devices. Once an eSIM profile is installed on a device, it becomes linked to that device.

If you change or replace your device, you may be able to transfer your active eSIM using the “Change eSIM” or equivalent functionality provided by 99esim.com (where available). In such cases, a new QR code or activation profile will be generated, and eligible active plans may be transferred to the new device, subject to technical compatibility and system limitations.

We do not guarantee that all devices or circumstances will support eSIM transfer, and we shall not be liable for any inability to transfer an eSIM resulting from device restrictions, user error, or third-party limitations.

8. Delivery of eSIMs

Upon successful payment and order acceptance, digital eSIM installation details (such as a QR code or activation code and instructions) will be delivered electronically. Delivery is typically made via email to the address you provide during the order process, or via your account dashboard on our Website. It is the user’s responsibility to provide a valid and correct email address and to ensure they can receive emails from us (check spam or junk folders). We are not responsible for failure of delivery due to an incorrect email address or other factors outside our control (such as email service issues). If you do not receive your eSIM details within a reasonable time after purchase, please contact our support for assistance. Once delivered, you should follow the provided instructions to download and install the eSIM on your device. Please note: a stable internet connection (Wi-Fi) may be required to install the eSIM on your device.

9. Refunds and Cancellation Policy

All sales of eSIM plans are generally final. Since our products are digital and can be delivered and used immediately, we do not offer cash refunds for purchased eSIMs except where required by law. However, we understand that exceptions may arise. Our refund and credit policy is as follows:

  • 9a. Device Incompatibility or User Error: No refunds or credits will be given if the eSIM cannot be used because your device is not eSIM-compatible or is carrier-locked, or if you failed to follow installation instructions. It is assumed that you have confirmed compatibility prior to purchase, as required, and accept this risk.
  • 9b. Activation/Technical Issues: If you encounter a technical problem that originates from our system or the eSIM provider which prevents you from installing or using the eSIM, you must contact us and cooperate with our support team to troubleshoot the issue. If the eSIM cannot be installed and used due to a proven technical fault on our side or the carrier’s side, and if you have made a good-faith effort to follow instructions and work with us to resolve the problem, you may be eligible for a refund or credit. In such cases, we will, at our discretion, either replace the eSIM or provide a refund in the form of store credit for the unused portion of your plan. The credit can be used toward future purchases on 99esim.com. Cash refunds will not be issued for these cases unless required by applicable law.
  • 9c. Duplicate Charges, Duplicate Purchases, or Account Top-Up Errors
    If you are charged more than once for the same transaction, or if duplicate payments are processed for the same eSIM purchase due to a system or payment error, you may contact us for review. Upon verification, we will issue a refund or store credit for the duplicate amount, at our discretion and in accordance with applicable law. In cases where a customer unintentionally purchases or tops up the same eSIM account multiple times (for example, when intending to purchase for a different account or device), we may, upon request and subject to verification, transfer or apply the unused package or data balance to another account or issue a store credit. Such adjustments are not guaranteed and are handled case by case, provided that the eSIM package has not been activated or used. We reserve the right to refuse refunds, credits, or transfers where there is evidence of misuse, abuse, fraud, or repeated errors inconsistent with good-faith consumer behavior.
  • 9d. Service Limitations by Providers: Occasionally, our third-party network providers may impose usage limitations, alter coverage, or discontinue support for a particular eSIM package (for example, a local carrier might unexpectedly limit or cut off service for a certain plan). These situations are beyond our control, and by using our service you understand and accept that risk. If a purchased eSIM plan is rendered unusable or significantly limited due to such provider actions, please notify us with details. While 99esim.com is not obligated to compensate for third-party network changes, we may review the circumstances case-by-case and, if deemed appropriate, offer a pro-rated credit for the remaining unused portion of your plan as a courtesy.
  • 9e. Unused Data or Expired Plans: eSIM data packages come with fixed data amounts and validity periods. It is your responsibility to use the data within the validity period. We do not offer refunds or credits for any unused data once a plan’s validity period expires, or for partially used plans. For example, if you purchase a 30-day plan and do not consume all the data or days, the unused portion will not be refunded after expiration.
  • 9f. Activated eSIMs: Once an eSIM has been delivered and activated (including by scanning the QR code, installing the eSIM profile on a device, or initiating any data usage), it is considered used and is generally not eligible for return, cancellation, or refund, as digital content cannot be deactivated and resold. This does not affect your rights in cases where the eSIM or related digital content is defective, non-conforming, or fails to function as described under applicable consumer protection laws. In such cases, and subject to verification, we will provide an appropriate remedy in accordance with applicable law, which may include repair, replacement, or a refund or credit for the affected portion of the service.
  • 9g. Accidental purchases where the eSIM has already been activated or where any data usage has occurred are not refundable.
  • 9h. Fraudulent or Abusive Purchases: We reserve the right to refuse any refund or credit if we find evidence of fraud, abuse of our refund policy, or violation of these Terms in relation to the purchase. Any accounts suspected of fraudulent activity may be suspended or terminated, and future access to our services may be denied.
  • 9i. Procedure for Refund/Credit Requests: If you believe you are eligible for a refund or credit under this policy, you must contact our refund support at finance@99esim.com and provide your order details and a description of the issue. Refund or credit requests will be evaluated on a case-by-case basis in line with the above criteria and our Terms. We may request additional information or evidence (e.g. screenshots, error messages) to assist in resolving your case. If a refund or credit is approved, we will inform you of the amount and issue it as store credit to your account (or process a refund to the original payment method if required by law or at our discretion). Please allow a reasonable processing time for any approved credits to be applied.
  • 9j. Digital Content Acknowledgment and Consent
    The eSIM products sold on 99esim.com constitute digital content that is delivered electronically. By placing an order for an eSIM, you expressly request and consent to the immediate delivery and performance of the digital content upon purchase. You further acknowledge and agree that, once delivery or activation of the eSIM begins, you lose any statutory right of withdrawal or cancellation to the extent permitted by applicable law. This acknowledgment does not affect your rights in cases where the digital content is defective, non-conforming, or fails to function as described under applicable consumer protection laws.
  • 9k. Wrong Package Purchased (Wrong Destination / Incorrect Plan Selection)
    If you accidentally purchase an eSIM package for the wrong destination or select an unsuitable plan, you may be required to purchase the correct package separately in order to receive service. Once you have successfully purchased the correct package, 99esim.com may, in its reasonable discretion, review your request and may issue a refund or store credit for the unused, incorrect package, provided that (i) the incorrect eSIM has not been activated, installed, scanned, or used (including any data usage), and (ii) the request is submitted promptly with your order details. For the avoidance of doubt, purchases of incorrect packages are not automatically refundable, and any approved refund will generally be issued as store credit, unless a cash refund is required by applicable law or we determine otherwise in our discretion.

Except as described above, we do not offer cancellations or refunds for eSIM purchases. Please make sure to review your order carefully before payment.

10. Privacy Policy

Our Privacy Policy governs the collection, use, and disclosure of personal information on the Website. By using our services or the Website, you acknowledge that you have read and understood our Privacy Policy and you consent to the collection and use of your information as described therein. The Privacy Policy is incorporated into these Terms by reference. If you do not agree with how we handle your data as outlined in the Privacy Policy, please do not use our services.

11. Intellectual Property

All content and materials on the Website – including but not limited to text, software, images, logos, graphics, videos, design elements, and compilations – are the property of 99esim.com or its content suppliers and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the Website and its content for your personal, non-commercial use in connection with our services. Any unauthorized reproduction, distribution, modification, or creation of derivative works from the Website content is strictly prohibited. You also agree not to remove, obscure, or alter any copyright, trademark, or other proprietary rights notices displayed on the Website or in conjunction with our services.

12. Disclaimer of Warranties and Limitation of Liability

Disclaimer of Warranties: The Website and all products and services provided through it, including eSIMs, are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, 99esim.com disclaims all express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Website or Services will be uninterrupted, error-free, secure, or free from delays. Network performance, coverage, speeds, latency, and availability depend on third-party telecommunications providers and may vary by location, device, or time. We make no guarantee regarding the reliability, quality, or availability of internet connectivity provided via an eSIM at any given time or location.

Limitation of Liability: To the fullest extent permitted by applicable law, 99esim.com, its owners, directors, officers, employees, affiliates, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, loss of connectivity, roaming charges, or other economic losses arising out of or relating to your use of, or inability to use, the Website or eSIM Services, even if advised of the possibility of such damages.

Without limiting the foregoing, we shall not be liable for any service interruptions, performance degradation, or failures caused by third-party network providers, device incompatibility, user error, or events beyond our reasonable control.

Where liability cannot be excluded under applicable law, our total aggregate liability for any claim arising out of or relating to the Services shall be limited to the amount actually paid by you for the specific eSIM plan giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, personal data protection violations, or mandatory consumer guarantees.

13. Indemnification

You agree to defend, indemnify, and hold harmless 99esim.com, its parent company, affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Website or eSIM services; (b) your breach of any provision of these Terms and Conditions; (c) your violation of any applicable law or regulation in connection with your use of the services; or (d) any content or data you transmit using our services. This means you will reimburse us for any losses or expenses (including legal fees) that result from your violation of these Terms or misuse of our service. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

14. Termination of Service

We reserve the right to suspend or terminate your access to the Website and the eSIM services at any time, with or without notice, if you breach these Terms and Conditions or engage in any activity that we, in our sole discretion, determine is harmful to our interests or the interests of other users, or if required by law. In the event of termination or suspension, you remain responsible for any obligations incurred up to the point of termination (including payment obligations) and any provisions of these Terms which by their nature should survive termination will continue to apply. If your account is terminated for violation of these Terms (for example, due to fraudulent activity or abuse), you may forfeit any remaining credits or services and may be barred from reopening an account or using our services in the future. We shall not be liable to you or any third party for any termination of your access to the service.

You are free to discontinue use of our services at any time by removing any eSIM profiles from your device and ceasing to use the Website. However, please note that discontinuing use of the service or deleting an eSIM from your device does not automatically entitle you to a refund (see the Refunds and Cancellation Policy above).

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Nothing in these Terms limits or affects any mandatory consumer rights under the laws of your country of residence.

16. Changes to Terms and Conditions

We reserve the right to update, revise, or replace any part of these Terms and Conditions at our discretion. Any changes will become effective immediately upon posting the updated Terms on the Website, unless stated otherwise. It is your responsibility to check our Website periodically for any changes to the Terms. We will indicate at the top of the Terms page the date of the latest revision. By continuing to use the Website or our services after any modifications to these Terms are posted, you signify acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using our services.

17. Force Majeure 

Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms and Conditions where such failure or delay results from events beyond its reasonable control (“Force Majeure Event”). Force Majeure Events include, but are not limited to, acts of God, natural disasters, pandemics, epidemics, war, terrorism, civil unrest, labor disputes, government actions, changes in law or regulation, failures or interruptions of telecommunications networks, power outages, internet service disruptions, or failures of third-party service providers or network operators.

During the continuation of a Force Majeure Event, the affected party’s obligations shall be suspended to the extent and for the duration of the Force Majeure Event. The affected party shall use reasonable efforts to mitigate the effects of the Force Majeure Event and resume performance as soon as reasonably practicable.

Nothing in this section shall limit or exclude any rights or remedies available to consumers under applicable mandatory consumer protection laws.

18. Severability

If any provision of these Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall remain in full force and effect.

19. Assignment

You may not assign, transfer, or sublicense any of your rights or obligations under these Terms and Conditions without our prior written consent. Any attempted assignment in violation of this provision shall be null and void.

99esim.com may assign or transfer these Terms and Conditions, in whole or in part, including in connection with a merger, acquisition, corporate restructuring, sale of assets, or by operation of law, provided that such assignment does not materially reduce your rights under these Terms.

This section does not affect any rights you may have under applicable mandatory consumer protection laws.

20. Language of the Terms

These Terms and Conditions are written in English and the English version shall be the sole legally binding version.

Any translations of these Terms are provided for convenience only. In the event of any inconsistency or discrepancy between the English version and any translated version, the English version shall prevail.
